An Overview
An Analysis of Procedural grounds

The construction industry is the second largest employer of manpower in the country. About half of planned expenditure is on construction and it contributes significantly to the GDP. However, this industry is faced with the problems of chronic disputes between the project authorities and the contractors, leading to time and cost over-runs. Studies show that construction works of over Rs. 80,000 crores are subject to dispute. Based on the UNCITRAL Model, the Arbitration and Conciliation Act 1996 provides the basis for an alternative dispute resolution system. The object of the Act is to provide speedy alternative solution to disputes by avoiding protraction of litigation. However the experience shows that in most of the cases arbitration proceedings take long period, leading to time and cost over-runs.

In order to provide the required focus on arbitration, specifically on institutional arbitration mechanism, a two-day National Conference on “Arbitration in India: An Overview, an analysis of procedural grounds” is being organised on December 11 -12, 2009, at Scope Complex, New Delhi, by Construction Industry Arbitration Council (CIAC).
